Copyright Policy for Malawi Research Hub

At Malawi Research Hub, we respect the intellectual property rights of others, and we expect our users to do the same. As such, we have implemented a copyright policy to address claims of copyright infringement.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been used or copied in a way that constitutes copyright infringement and is accessible on the Malawi Research Hub website or through our services, please provide our designated agent with a written notification that includes the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;

  2. Identification of the copyrighted work claimed to have been infringed;

  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;

  4. Your contact information, including your address, telephone number, and email address;

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that if you knowingly misrepresent that material or activity on our website or services is infringing your copyright, you may be held liable for damages (including costs and attorneys' fees).

2. Counter Notification

If you receive a notification from us that we have removed or disabled access to material that you provided because we received a claim of copyright infringement, and you believe that the claim was made in error or that you have the right to use the material, you may send us a counter-notification.

Your counter-notification must be in writing and must include the following information:

  1. Your physical or electronic signature;

  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled;

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you are located (if you are located outside the United States, you consent to jurisdiction of the courts of your country of residence); and

  5. A statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly provide the person who provided the original notification with a copy of the counter-notification, and we will replace the removed material or cease disabling access to it in not less than ten (10) business days, unless our designated agent receives notice from the person who provided the original notification that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our website or services.

3. Repeat Infringers

Malawi Research Hub may, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual property rights.

4. Changes to this Copyright Policy

We may update this copyright policy from time to time by posting a new version on our website. You should check this page regularly to ensure that you are familiar with any changes.
